Apply for temporary unemployment
1.Go to Recurring actions.
2.Click on Administration of temporary employment.
An overview list of the submitted requests is displayed.
3.Select an option in the field Faites votre choix : Les étapes à suivre en cas de déclaration (Select an option: Steps to be followed for a declaration of).
4.You will now be forward to a page where you can enter more information about what to do beforehand and at the start, as well as when and for whom.
You can submit a notification or monthly report here.
5.Complete all the required fields. Further information about the fields for the various types of temporary unemployment is available below.
6. See also: Consult, change, terminate or delete comment regarding selection (of contracts).
7.Click Enregistrer en envoyer (save and send).
8.Do not forget to complete the monthly calendar.
Types of temporary unemployment
If there is insufficient work for all employees (e.g. due to a temporary fall in the number of orders), the employer can introduce a temporary unemployment scheme based on lack of work on economic grounds. Under this scheme, the employees continues to be employed, but the execution of their employment contract is suspended temporarily, whether in full or in part. This allows for potential redundancies to be avoided.
Comments
•Aside from force majeure, this is the only type of temporary unemployment that can also be used for white-collar workers. •Before you can request a first day economic reasons, a notification for economic reasons must be made. •If you do not submit a notification for economic reasons via Payroll, SD Worx can only draw up a correct WECH002 and/or WECH005 if you submit economic reasons at departmental level. Only then will SD Worx have the correct data. •Only temporary unemployment for economic reasons can be extended. This is done in Follow up economic unemployment

•Full suspension
A scheme with full suspension is possible for maximum 4 weeks (28 calendar days). The scheme can start on any day. When the maximum duration of 4 weeks is reached, the employer is under obligation to introduce a full working week of 7 working days before starting a new scheme. Comment
A scheme with only one working day per two weeks is the equivalent of a full suspension and can be requested for maximum of four weeks.
•Partial suspension
There are two possibilities. The system determines which suspension regime applies on the basis of the weekly work schedule (the number of working days and unemployment days) or the fortnightly work schedule (less or more than 1 week of work out of 2). oMajor suspension
If the employees work less than three working days per week or less than one working week per two weeks, this is referred to as a major suspension. This scheme can be requested for a maximum of 3 months (i.e. 3 calendar months, 3 months from date to date or 13 calendar weeks).
If the maximum duration of 3 months is reached, the employer is under obligation to introduce a full working week of 7 working days before starting a new scheme. oMinor suspension
If the employees work at least three working days per week or at least one working week in every two weeks, this is referred to as a minor suspension. This scheme can be requested for longer than 3 months. However, this does not mean that the scheme can be introduced for an indefinite period of time. In all cases, the announcement must be made to specify and end date (maximum 12 months). Note:
In the event of temporary unemployment on economic grounds for white-collar workers, a minor suspension is automatically passed on as a major suspension. This is specified in the instructions of the National Employment Office (RVA)/National Office of Social Security (NSSO). However, the requirement is for the Employé (white-collar worker) field to be ticked under Motif (Reason).

When the full suspension or partial suspension scheme has reached the maximum duration of 4 weeks or 3 months (for major suspension), the employer is under obligation to re-introduce the full-time work schedule for a full week before they may start a new scheme. A unbroken period of 7 calendar days is considered to be a complete working week.

The compulsory working week does not apply in case of a minor suspension.

Contrôle et envoi (control and dispatch)
|
From 01/01/2025, the electronic control card will be mandatory for all employees. This means that you as an employer:
•no longer need to keep a validation book and •no longer need to request paper control cards and hand them over to employees. The obligation means that you only see a text under Cartes de contrôle et envoi.
The obligation is not applicable to employees within JIC 327 sheltered workshops, social workshops and customised workshops. This industry may continue to use the paper control card.
Deviation at employee level
If you, as an employer, opt for electronic control cards C3.2, you can temporarily deviate from this at employee level. For these employees, you must still provide paper control cards C3.2 and enter them in the validation book.
As an employer, you can apply for a temporary exemption from the obligation to use an electronic control card using a form made available by the NEO. This exception is valid for three months and can be requested a maximum of two times.

Every month, the first day of economic unemployment must be reported, in addition to the notification of temporary unemployment on economic grounds.
The monthly announcement from the first effective day of unemployment may occur:
•on the first day of the actual suspension of the execution of the employment agreement; •at the latest on the working day following the first day of the suspension of the execution of the employment agreement; •if the employer knows for certain that the execution of the employment contract will indeed be suspended, at the earliest on the fifth working day preceding the first effective day of unemployment. This last point is valid for blue-collar workers only.
In Payroll, the announcements of the first effective day of unemployment can be recorded in advance (from the start of the current month). These announcements are saved by SD Worx and are sent to the authorities on the day of effective unemployment. SD Worx will continue to use this method in Payroll for the time being.

•unfavourable weather conditions: frost, rain, heat, etc. •the employer is obliged to report poor weather to the National Employment Office (RVA); •the weather conditions must be so bad that it is not possible to execute the work (and not just make it difficult to work): •a direct causal relationship must exist between the bad weather and the work at hand. Example: Frost that makes masonry work impossible; rain that prevents a company responsible for road marking from performing its tasks because the road surface is wet.

What is force majeure?
•sudden, unexpected events •that occur beyond the control of the parties, •and prevent the performance of the employment contract in full •and that are temporary in nature. Force majeure is a type of temporary unemployment requiring a notification to be sent to the National Employment Office (RVA).
If you do send a notification, you can do so via Payroll (in the Risque (Risk) field, select the Force majeure value) or via the site of the NSSO (RSZ).
If you do not send a notification (via Payroll or via the NSSO site), you must provide additional details via this channel. SD Worx needs these details to be able to properly draw up WECH002 and/or WECH005.
Note:
For medical force majeure, you are not allowed to submit a temporary notification for Force majeure.

Change or consult temporary unemployment
To consult or change the temporary unemployment status, click the button
on the Administration of temporary unemployment screen.
Important: You can only delete a notification for a limited period of time. The duration of this period depends on the selected risk. You will receive a message telling you when the period has elapsed.
Delete temporary unemployment
You cannot delete a risk of temporary unemployment if
•the current date is greater than the 15th day of the month following the start date and the Risque (Risk) field contains the First day – Economic reasons or Poor weather
•the current date is greater than the last day of the month of the end date and the Risque (Risk) field contains the value Economic reasons, Technical failure or Force majeure.
Note:
You can only delete a notification for a limited period of time. The duration of this period depends on the selected risk. You will receive a message telling you when the period has elapsed.
After deleting a case of temporary unemployment, the declaration of the temporary unemployment remains visible in the list. The information is then available to view only.
An overview list of the submitted risks is displayed on the Administration of temporary unemployment screen.
1.Click on Administration of temporary employment.
An overview list of the submitted requests is displayed.
2.Select the risk you wish to delete from the overview list.
3.When finished, click on
.
4.Click OK if you want to confirm deletion of the temporary unemployment status.
Today's date is displayed in the overview list in the Cancel date field.
View, change, terminate or delete comment regarding selection (of contracts).
The Sélection tab displays an overview of all contracts. In case of 1st day economic reasons this only happen once the date from has been entered.
Ticked contracts apply to the requested temporary unemployment.
All contracts in the file with the same site number that apply to the notification are displayed in case of 1st day economic reasons (these are the same contracts and site numbers as the ones in the notification.
Change, terminate or delete
1.Go to Recurring actions.
2.Click on Administration of temporary unemployment.
An overview list of the risks for temporary unemployment is displayed.
3.Select the temporary unemployment of your choice in the risk column.
4.Click on
(details).
The Caractéristiques (properties) and Sélection (selection) tabs are displayed at all times.
lf the risk field contains the 1er jour Causes économiques (first day economic reasons) or Intempéries (bad weather) value, an extra tab is also displayed for each site.
5.Go to the Sélection tab.
6.All contracts in the file are displayed. Only the ticked contracts apply for the risk.
▪You can tick (extra) contracts to add them.
Note
It is no longer possible to add employees to a declaration that has already been made (notification or first day). In this case, you must therefore create a new declaration.
▪For each risk, you can untick contracts to delete them. The Terminer l'enregistrement au (Terminate registration on) field is displayed. Leave the field empty.
▪For the economic reasons risk, you can untick the contracts to terminate them. The Terminer l'enregistrement au (Terminate registration on) field is displayed. Enter a date.
Comment
For the Demander les cartes de contrôle uniquement (Inspection cards only) risk, you are only entitled to view the contracts. You are not able to add or delete any contracts.
6.Click Enregistrer (save).

Example: for an employee who lives in Antwerp and works in Liège, you will need to enter French as the language.
